FDA Detects Melamine Contamination in Flavored Drink

The U.S. Food and Drug Administration (FDA) has increased inspections (http://www.fda.gov/bbs/topics/NEWS/2008/NEW01896.html)and product testing efforts in response to the melamine contamination problem which originated in Chinese dairy products. As a result of the FDA's on-going testing program, the agency has detected melamine contamination in Blue Cat Flavor Drinks. The distributor of the product, Tristar Food Wholesale Co. Inc., initiated a recall of several flavors of Blue Cat Flavor Drink, based on the FDA’s findings. The FDA advises the public not to consume this product and recommends that retailers and food service operators remove the product from sale or service.

McCormick and Company Has Recalled McCormick Enchilada Sauce Mix Due To Unlabeled Milk Ingredients (September 30)

The McCormick Enchilada Sauce Mix (http://www.fda.gov/oc/po/firmrecalls/mccormick09_08.html)was distributed to grocery stores nationally beginning on September 17, 2008. The product comes in 1.5 oz. pouches with an expiration date of "best by" AUG2910CH. The date is found printed in black on the back, bottom left of the pouch.

Consumer Alert: Undeclared Sulfites in Shad Raisins (October 6)

New York State Agriculture Commissioner alerted consumers that Fatima Brothers Inc. of Maspeth, New York is recalling Shad Raisins due to the presence of undeclared sulfites. The recalled Shad Raisins were packaged in uncoded, 7-ounce plastic bags. Shad Raisins were distributed in New York City.

Consumer Alert: Possible Botulism Contamination in Frozen Salted Croaker (October 6)

New York State Agriculture Commissioner alerted consumers not to eat Frozen Salted Croaker distributed by YS Trading Corp, Long Island City, New York because the product was uneviscerated. The Frozen Salted Croaker was sold in Hicksville, New York, Flushing, New York, and New Jersey in un-coded, unlabeled plastic bags.

Mercedes Benz M Class 1998-2003 Vehicles (Tue 16 Sep 2008) Mercedes-Benz is recalling 102,954 MY 1998-2003 M-Class vehicles. The hose clamp used to secure the power steering fluid cooling hose to the power steering fluid cooler may not provide sufficient clamping force for this connection.The loss of power steering fluid may result in diminished power steering over time and ultimately can damage the power steering pump. This could result in a loss of control and a crash without warning.

Saturn Vue 2008-2009 Vehicles (Tue 16 Sep 2008) GM is recalling 42,408 MY 2008-2009 Saturn Vue vehicles. Some of these vehicles have a condition in which the nut securing the power steering line to the power steering pump may loosen. If this were to occur, there may be a power steering fluid leak. The fluid could contact hot exhaust components resulting in a possible engine compartment fire.

Kawasaki VN900B9F, VN900B9FL, VN900C8F, VN900D8F 2008-2009 Motorcycles (Tue 9 Sep 2008) Kawasaki is recalling 604 MY 2008 Vulcan VN900C8F, VN900D8F, and MY 2009 VN900B9F, and VN900B9FL motorcycles. Fuel can leak from between the tank filler neck and the fuel cap gasket. Fuel leakage in the presence of an ignition source can result in a fire.

Yamaha XC50, XF50 2007 Motorcycles (Tue 9 Sep 2008) Yamaha is recalling 4,800 MY 2007 XF50 and XC50 motorcycles. A crack may develop on the connecting rod. If the engine continues to be run, the crack will develop further and the connecting rod may break. If the connecting rod breaks, the engine will stop and cannot be restarted increasing the risk of a crash.

Triumph Sprint ST 1050 2008 Motorcycles (Tue 9 Sep 2008) Triumph is recalling 372 MY 2008 Sprint ST motorcycles. There is a possibility that the single bolt that is used in the 3 positions on the rear suspension drag link assembly can become brittle and fracture. The bolts involved are the (1) drag link to drop link bolt, (2) drag link to frame bolt, and (3) drop link to rear suspension unit bolt. The head of the bolt may detach causing the drag link assembly to come apart resulting in loss of rear suspension, increasing the risk of a crash.

Kia Motor Rondo 2008-2009 Vehicles (Mon 8 Sep 2008) Kia is recalling 6,680 MY 2008-2009 Rondo LX and EX vehicles equipped with a 2.4 liter engine. The fuel pump may not operate properly resulting in not enough fuel getting to the engine. Poor engine starting, engine hesitation, and other impairment may result, and the check engine light may illuminate. Unusually severe impairment while driving could expose the driver to the risk of a crash.

Mitsubishi Eclipse, Eclipse Spyder, Endeavor, Galant 2005-2007 Vehicles (Mon 8 Sep 2008) Mitsubishi is recalling 45,988 MY 2005-2007 Endeavor, Galant, Eclipse Coupe, and MY 2007 Eclipse Spyder vehicles. The bracket that is the attachment point for the left rear fuel tank mounting strap may have been improperly formed during a metal stamping process. The process may have caused the metal to have a split in the area where the bolt that holds one of the two fuel tank straps to the underside of the vehicle is located. In the event the fuel tank is full and the vehicle is subject to a severe collision, the bracket may break and allow the fuel tank to drop down, possibly causing a fuel leak. Fuel leakage in the presence of an ignition source could result in a fire.

Hummer H2 2003 Vehicles (Mon 8 Sep 2008) GM is recalling 13,358 MY 2003 Hummer H2 vehicles. Some of these vehicles have a condition in which water can enter the windshield wiper motor module. If a sufficient amount of water enters the module, over time, the front windshield wipers may work intermittently or they may become inoperative. If this were to occur, driver visibility could be reduced, which could result in a vehicle crash.

Scion XB 2008-2009 Vehicles (Fri 5 Sep 2008) Southeast Toyota is recalling 64 MY 2008-2009 scion XB vehicles installed with the sports grill option and also several radiator grills sold as parts. These vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard No. 113, "Hood latch system." It has been determined that should the primary hood latch be released or fail, the plastic upper radiator grill garnish could release the secondary latch and cause the hood to open. During vehicle operation, this could obstruct the view of the driver possibly cause the hood to strike the roof or the windshield increasing the risk of a crash.

Nissan Altima 2009 Vehicles (Thu 4 Sep 2008) Nissan is recalling 3,403 MY 2009 Altima vehicles equipped with 16-inch alloy wheels. Some these wheels may not have been manufactured to specification. This could cause one or more of the five lug nuts attaching the wheel to the vehicle to become loose. If the lug nuts become loose, it could eventually result in a loss of control and a crash without warning.

Dodge Challenger 2008-2009 Vehicles (Thu 4 Sep 2008) Chrysler is recalling 6,636 MY 2008-2009 Dodge Challenger vehicles equipped with automatic transmissions and "keyless go" option for failing to conform to the requirements of Federal Motor Vehicle Safety Standard No. 114, "Theft prevention." If the stop/start button is pressed and held and the engine turns off, the electronic key code is removed from the vehicle. Since this can occur in a transmission or gear selector position other than "park," and the transmission or gear selector does not become locked in "park" as a direct result of key removal, it was determined that a noncompliance may exist. This standard specifies vehicle performance requirements intended to reduce the incidence of crashes resulting from theft and accidental rollaway of motor vehicles.

Jeep Liberty 2008 Vehicles (Thu 4 Sep 2008) Chrysler is recalling 494 MY 2008 Jeep Liberty vehicles. The windshield and/or fixed rear quarter glass may have been assembled using incorrect urethane adhesive. This could affect glass retention. If the glass separates while driving, it could strike another vehicle or injure a pedestrian.

Chevrolet HHR 2006 - 2008 Passenger Vehicles (Wed 3 Sep 2008) GM is recalling 296,422 MY 2006-2008 Chevrolet HHR vehicles for failing to comply with the requirements of Federal Motor Vehicle Safety Standard No. 201, "Occupant Protection In Interior Impact." The door on the storage bin in the top center of the instrument panel failed to remain closed as required. This standard specifies performance requirements to provide head impact protection for occupants.

Victory Vision 2008 Motorcycles (Tue 2 Sep 2008) Polaris is recalling 2,444 MY 2008 Victory Vision motorcycles. The terminal nuts that secure the main power supply wires could be loose at the circuit breaker, which can cause an unexpected loss of electrical power to the motorcycle and the current fuel ignition map pre-programmed into the Electronic Control Module (ECM) can cause engine stalling.Either condition could cause the engine to stall, increasing the risk of a loss of control and a crash.

Prevost H3-41, H3-45, X3-45, XLII-45, XLII-45E 2008 - 2009 Motor Homes and Coaches (Fri 29 Aug 2008) Prevost is recalling 189 MY 2008-2009 XLII-45, XLII-45E, X3-45 motor homes and H3-41 and H3-45 coaches. Due to improper installation of the escape hatch retaining bolts, these bolts can break. If the bolts break, the escape hatch can fall down on to the roadway, increasing the risk of property damage or a crash.

A short circuit on the printed circuit board for the washer fluid heater may overheat the control-circuit ground wire. This may cause other electrical features to malfunction, create an odor, or cause smoke increasing the risk of a fire.

BlueBird Micro Bird 2006 - 2009 School Buses (Tue 26 Aug 2008) Blue bird is recalling 803 MY 2006 through 2009 Micro Bird school buses manufactured from July 27, 2005, through August 20, 2008, equipped with optional wheelchair lifts. The wheelchair lift enable switch, if set to the "off" position while the lift is deployed can render the wheelchair interlocks inoperative. When the lift enable switch is activated the door brake interlocks could be disabled and the bus could be moved while the lift is deployed which could result in property damage or personal injury.

FOR IMMEDIATE RELEASE -- October 9, 2008 -- Kansas City, MO – In specific U.S. markets (below), Russell Stover Candies, Inc., is recalling one lot code of its 2 7/8 oz size of Private Reserve Assorted Chocolates because one piece of candy in the assortment may contain undeclared hazelnuts due to a labeling error. Consumers allergic to hazelnuts run the risk of a serious allergic reaction if they consume this piece of candy. No incidents of illness or allergic reaction have been reported.

The recalled product was distributed in the following states and cities: Texas, California, Louisiana, North Carolina, South Carolina, Virginia, Tennessee; Southaven, Mississippi; Billings, Montana; Sparks, Nevada; and Madison Heights, Michigan. An investigation determined 29 boxes of this candy may have been purchased by consumers, and up to another 188 boxes may have reached retail store locations. All the retail stores have been contacted to have the suspected product removed from the shelves.

The candy containing the hazelnuts comes in a box with a red lid and gold border. The box is held closed by a gold cord tied in a bow. A label on the bottom right corner of the box identifies it as "Assorted Chocolates, Net Weight 2 7/8 oz." The side of the box is marked "01JUL09 N0349." Only product with the "N0349" lot code is affected.

The recall was initiated after discovering some of this product was manufactured with an incorrect bottom label, which does not list hazelnuts as an ingredient. The box contains six pieces of candy, but only one of them is covered in white chocolate, which is the piece that contains the hazelnuts.

Consumers who have purchased 2 7/8 oz packages of Russell Stover Private Reserve Assorted Chocolates, with the lot code ending in "N0349" are urged not to consume the white chocolate piece if they are allergic to hazelnuts. FOR IMMEDIATE RELEASE -- St. Louis, MO – October 15, 2008 – ETHEX Corporation announced today that it has voluntarily recalled three specific lots (77946, 81141 and 81142) of Dextroamphetamine Sulfate 5 mg tablets, as a precaution, due to the possible presence of oversized tablets. Oversized tablets may contain as much as about twice the labeled amount of the active ingredient. The recalled lots were distributed by ETHEX Corporation under an "ETHEX" label between January 2007 and May 2008. The 5 mg product is an orange round tablet debossed with "ETHEX" and "311" on one side.

If someone were to take a higher than expected dose of Dextroamphetamine Sulfate, then the risk of adverse effects known to be associated with the drug such as tachycardia, hypertension, tremors, decreased appetite, headache, insomnia, dizziness, blurred vision, stomach upset, and dry mouth may be increased.

No report of any oversized Dextroamphetamine Sulfate tablets has been received by ETHEX from any wholesaler, retailer, consumer or caregiver, and ETHEX has not received any report of unexpected side effects or injury related to this product.

ETHEX Corporation is conducting this precautionary, voluntary recall because it found a small number of oversized tablets in lots which had not yet been distributed. These oversized tablets were removed before the lots were distributed.

Please be aware that there are multiple companies in the United States producing and marketing generic versions of Dextroamphetamine Sulfate 5 mg tablets and consumers and their caregivers are encouraged to check their prescriptions to determine the source of their tablets.

The pet food is being voluntarily recalled following a positive test result indicating a potential contamination with Salmonella.

Salmonella can cause serious infections in dogs and cats, and, if there is cross contamination caused by handling of the pet food, in people as well, especially children, the aged, and people with compromised immune systems. These tires were produced with insufficient tread base gauge. Continued use of the subject tires may lead to vibration and groove cracking. This advisory applies to Carter’s Fall 2007 product line. The Fall 2007 line utilizes a label on the inside back of the garment that has a raised surface with a solid, rather than a stenciled, background. This advisory does not apply to previous and current product lines, which utilize labels with stenciled backgrounds.

The garments, which were made in various countries, were sold at Carter’s own retail stores and at department and national chain stores.

If your child develops a rash on the upper back after wearing garments that have a “tag-less” label with a solid background, you should stop using these garments. Infant Death Prompts Recall to Repair 985,000 Delta Enterprise Drop Side Cribs; Missing Safety Pegs Can Cause Entrapment and Suffocation Hazards

WASHINGTON, D.C. – The U.S. Consumer Product Safety Commission (CPSC), in cooperation with Delta Enterprise Corp., of New York, New York., is announcing the voluntary recall to replace missing safety pegs involving 985,000 drop side cribs. Failure to use or install safety pegs can cause an entrapment and suffocation risk to infants and toddlers.

When the safety pegs in the base of each leg of the crib are missing from the lower track, the crib locks can disengage and detach if lowered below the peg hole, creating a hazardous gap. This gap can lead to the entrapment and suffocation of an infant or toddler.

CPSC staff is aware of a death of an 8-month-old child who became entrapped and suffocated when the drop side of the crib detached in a reassembled crib where the safety pegs were not installed. CPSC is also aware of two entrapments and nine disengagement incidents in cribs where the safety pegs were missing.

The recall involves all Delta cribs manufactured in Taiwan or Indonesia, with the “Crib Trigger Lock with Safety Peg” drop side hardware design. The recalled cribs have date codes ranging from 1995 through December 2005 and one model (4624) was made in 2007. The model numbers are located on the top of the mattress support board.

The cribs, which were made in Taiwan and Indonesia, were sold at major retailers, including Walmart, Kmart and Target.com from January 1995 through September 2007 for about $100. These cribs have also been found to be sold secondhand. Cribs currently sold at retail are not involved.

CPSC and Delta urge parents and caregivers to immediately stop using cribs that are missing a safety peg on any leg of the crib and contact Delta to receive a free, easy-to-install repair kit. The kit will include safety pegs in a bold color and warning labels to be affixed to the mattress board. Consumers with cribs that have all safety pegs installed may continue to use the cribs; however, CPSC recommends that these consumers contact Delta for the repair kit for future assembly purposes. Parents and caregivers are encouraged to find a safe, alternative sleep environment for their child if their recalled crib is missing safety pegs.

CPSC would like to remind parents not to use any crib with missing, broken, or loose parts. Make sure to tighten hardware from time to time to keep the crib sturdy. When using a drop side crib parents should check to make sure the drop side or any other moving part operates smoothly. Always check all sides and corners of the crib for disengagement. Any disengagement can create a gap and entrap a child. In addition, do not try to repair any side of the crib, especially with tape, wire or rope.

Mexican "Vanilla" With Coumarin: No Bargain

Tourists tempted to pick up bargains south of the border should beware of one bargain that isn't always a good buy—so-called Mexican "vanilla." This flavoring product may smell like vanilla, taste like vanilla, and be offered at a cheap price. But it's often made with coumarin, a toxic substance banned in food in the United States.

In addition to being sold in Mexico and other Latin American countries, the coumarin-containing product has appeared on the shelves of some U.S. stores. The Food and Drug Administration (FDA) advises consumers not to purchase this product.


Pure vanilla is made with the extract of beans from the vanilla plant, a type of orchid that grows as a vine. Mexican vanilla is frequently made with the extract of beans from the tonka tree, an entirely different plant that belongs to the pea family. Tonka bean extract contains coumarin, a compound related to warfarin, which is in some blood-thinning medications. Eating food containing coumarin may be especially risky for people taking blood-thinning drugs because the interaction of coumarin and blood thinners can increase the likelihood of bleeding.
Coumarin Banned in Food

Since 1954, FDA has banned coumarin from all food products sold in the United States. Yet the agency has found Mexican vanilla with coumarin in some ethnic food stores and Mexican restaurants in the United States. These products usually have been improperly brought into the country.
If vanilla products that were suspected of containing coumarin were shipped through regular commercial channels, FDA and the U.S. Customs and Border Patrol would stop them at the border because these products are listed on an import alert. An import alert document identifies manufacturers and products that have a history of—or are suspected of—violating the law so that federal agents can keep the products from entering the United States. It is important to note that not all vanilla from Latin American countries contains coumarin. (See the list of manufacturers in the Import Alert under "For More Information.")
Standards for Vanilla FDA standards specify that only vanilla beans can be used to make vanilla for use in any food product. Vanilla-like flavors that don't meet the standard must be labeled as "imitation" vanilla and must be made from safe ingredients that are permitted for that use.

FDA does not allow tonka bean extract even in imitation vanilla. Because they contain coumarin, tonka beans do not meet the food safety requirements for sale in the United States under the Federal Food, Drug, and Cosmetic Act.
Tips for Consumers



Be wary about buying vanilla in Mexico and other Latin American countries. Look for "vanilla bean" in the ingredient list on the label. If it has "tonka bean" or if there is no ingredient list or a vague one, avoid this product.
Don't risk your health to save a few dollars. Vanilla with coumarin is generally sold at a lower price than pure vanilla because tonka beans are cheaper to grow than vanilla beans. If the price sounds too good to be true, pass it up.
Don't buy a food product in the United States that is not labeled in English. Products may have Spanish or other non-English labeling, but they must also have complete English labeling to meet U.S. Government standards. (Products sold only in Puerto Rico are an exception—they are not required to be labeled in English.)

The Food and Drug Administration ignored evidence when concluding that a chemical in plastic baby bottles is safe, according an expert panel asked to review the agency's handling of the controversial substance.

The Food and Drug Administration ignored evidence about the danger posed by a chemical in plastic baby bottles, according a report released Wednesday.

The excluded studies suggest bisphenol A, or BPA, could pose harm to children at levels at least 10 times lower than the amount the agency says is safe, according to the report written by outside scientists asked to review the agency's handling of the controversial substance.

Excluding evidence of harm "creates a false sense of security" about BPA, the panel's report says.

The scientists took the FDA to task for basing its safety decision in August on three industry-funded studies. Another government agency, the National Toxicology Program, decided many other independent studies deserved consideration. The toxicology program concluded last month there is "some concern" that BPA alters development of the brain, prostate and behavior in children and fetuses.

The expert panel also found the FDA underestimated how much BPA babies ingest on several counts. For one, the agency failed to consider the cumulative effect of being exposed to BPA from dozens of products, a fundamental error that "severely limits the usefulness" of the FDA's safety estimate.

An advocacy group, the Natural Resources Defense Council, believes BPA is too toxic to use in baby products at all. The group formally has asked the FDA to remove BPA from food and beverage containers.

The new report was written by a subcommittee of the FDA's outside science board, experts who advise the FDA on complex issues. The full science board, scheduled to meet Friday, can endorse the subcommittee's report or write its own.

In a statement, the FDA said the subcommittee's report "raises important questions" and says it is planning to do additional research on BPA.

In a statement, the American Chemistry Council, an industry group, said members will comply with the FDA's final decision, even if that means phasing out BPA.

The subcommittee has attracted controversy itself. The FDA's deputy commissioner for policy, Randall Lutter, has recommended the subcommittee chairman refrain from voting because of allegations of conflict of interest. Lutter said there is no reason the chairman, Martin Philbert of the University of Michigan, should step down. Philbert heads a research center that has accepted funding from the chemical industry.

More than 20 million toys were recalled last year because of problems ranging from toxic lead paint to magnets that were lethal when swallowed. The toy industry has since spent an estimated $200 million to enhance safety procedures. Congress overhauled the Consumer Product Safety Commission, increasing its budget by almost a third.

But what couldn't be repaired were the reputations of the tainted brands. That left toy makers with a difficult choice: abandon the products and start new lines from scratch, or relaunch the toys with new names.

Hit toys are rare in the industry and companies -- operating under tight margins -- are under pressure to keep a trendy product alive. But the stigma of a large recall can potentially sink both a toy and its manufacturer. "When a brand gets tainted, you have to either aggressively fight it or pull the plug," says Sid Kaufman, a licensing executive at Los Angeles-based consulting firm Brand Sense Partners who has also worked in the toy industry.

"These guys are fighting for their lives as companies and for their credibility with retailers and consumers," says Mr. Kaufman.

Last year's recalls were part of a cascade of defective consumer products made in China. The toy that was marketed under the names Aqua Dots and Bindeez suffered some of the worst headlines and was recalled after several children in the U.S. and Australia swallowed large numbers of the beads and slipped into comas.

The toy contained a substance that when digested became GHB, an acid more colloquially known as a date-rape drug for its use in sexual assaults. Spin Master says a Chinese factory failed to use a nontoxic chemical. The company recalled 4.2 million units and destroyed remaining products.

Spin Master President and Co-Chief Executive Anton Rabie says the company's recalls were swift and that his company worked around the clock to warn consumers and retailers of the problems.

But some damage was already done. "It was one of the worst recalls of the year," says Gerald L. Storch, chairman and chief executive of Toys "R" Us Inc., which sold Aqua Dots. "When you find out a product has the date-rape drug, that's not a good day."

Spin Master considered retiring the toy, says Mark Sullivan, who heads the company's marketing and design. But Spin Master "had invested millions of dollars in product development, manufacturing and TV commercials" for Aqua Dots and "customers were saying they love the toy."

So the company abandoned the Aqua Dots name but not the toy. "We're not trying to fool anyone," says Mr. Sullivan. By calling the toy Pixos, he says, the company isn't just rebranding it, but also allowing parents to distinguish the new product from the old, dangerous one. To save costs, Spin Master even repurposed old commercials for this year, replacing the Aqua Dots jingle with a riff that goes "p-p-p-Pixos!"

Not all brands can be so easily retooled. Thomas & Friends, the toy train line made by Oak Brook, Ill., company RC2 Corp., was recalled for containing lead paint last year. But the Thomas brand, which is owned by Hit Entertainment Ltd., appears not just in toys but branded books, puzzles and its namesake television show. The brand was largely unchanged this year.

Likewise, toys using cartoon characters Dora the Explorer and Sarge, the animated military jeep from the Walt Disney Co. movie "Cars," both involved in lead recalls from Mattel Inc., haven't been given a facelift by their license owners.

However, some smaller toy companies with lesser-known brands are trying to reinvent themselves. On many toy aisles this fall is a new construction toy called MagNext -- a close relative of a product called Magnetix, manufactured by Mega Brands Inc. of Toronto.

Magnetix was recalled in 2006 when a child died and others were seriously injured after swallowing its high-powered magnets. Mega Brands redesigned the toy in 2007 so the magnets couldn't be swallowed.

But when Mattel recalled 18 million toys last year for a similar problem, the company was thrust back in the spotlight, Mr. Chizick said. Sales plummeted in the fall and the company posted a loss.

Mega Brands had already been working on a newer, sturdier version of the toy, and so it decided to release it under a new name, Mr. Chizick said.

"We needed to rebrand," he said. "Obviously, with the recalls and what was happening in the marketplace, we changed the name to MagNext."

The new toys contain no reference to the original. Instead, the company opted to mark their packaging with the brand Mega Bloks, the company's building-blocks brand that had no previous association with its magnet toys.

Also new on the toys' packaging is a logo for Intertek, a third-party testing agency that reviewed the design of the toys for safety before they were manufactured.
